Terms of Service

These terms are the agreement between you and Talli, and they are the regulamin that Polish law requires an online service to publish. The first section is the short version; the rest is what actually binds.

§ 1

The short version

A summary, not a substitute. The sections below are what binds.

  • Talli is a search engine for parking in Warsaw, and a booking tool for the spots that owners list with us directly.
  • We do not own, manage or control a single parking space on this site, and we are not a party to your rental agreement.
  • Reserving means paying the first month’s rent and having the spot held for you. Talli’s own fee for that is currently nothing, and any fee we ever introduce will be shown before you pay.
  • A confirmed reservation can be cancelled free within 24 hours. You also have statutory rights as a consumer that nothing in this document can cut down.
  • Listings copied from other sites appear as their author published them. We do not verify them, and they cannot be booked here.

§ 2

Who you are contracting with

Talli operates tallipark.com. You can reach a person at hello@tallipark.com.

Polish law governs these terms. If you are a consumer, nothing here removes the protection of rules that apply to you regardless of what a contract says — including the mandatory consumer rules of the country you live in.

§ 3

What Talli does, and what it does not

Talli does two things. It gathers parking and garage offers for Warsaw into one searchable place, and it lets the owners who list with us take a booking.

It is not an estate agency, not a property manager, not an insurer and not a parking operator. We hold no keys and control no barrier. Whatever you agree with an owner, you agree with them.

The distinction that matters most on this site is where a listing came from:

  • Indexed listings are public advertisements published on OLX or Otodom. They keep a link back to where they were published, appear broadly as their author wrote them, and cannot be reserved through Talli.
  • Owner listings are submitted through the site by whoever owns or controls the space. Only these can be reserved, and only while online payment is available.

§ 4

Your account

Searching, viewing listings, using the map and generating a rental agreement need no account. You need one to reserve a spot, save a spot, set an alert, message an owner, see a listing’s phone number, or publish a space of your own.

  • You must be at least 16 to hold an account, and at least 18 and legally able to enter a contract to make a reservation or publish a listing.
  • Give a real name and an email address you control. It is how we reach you about your bookings, and a bad address means a booking you never hear about.
  • The account is yours alone. Do not share the login, and tell us at hello@tallipark.com if you think somebody else has it.
  • Close it whenever you like by asking at hello@tallipark.com.
  • We may suspend or close an account used to break these terms, to harass somebody, or to collect other people’s contact details in bulk. Where it is reasonable to do so, we say why first.

§ 5

Reservations and payment

A reservation is a hold, not a lease. It buys you the spot off the market for your dates and an introduction to its owner.

  • You pay one month’s rent at the price shown on the listing. Talli’s fee is currently 0 zł. Any fee we introduce will be a separate line you see before paying, never a deduction discovered afterwards.
  • Payment is taken by Przelewy24. You choose BLIK, card or a bank transfer on their page. Talli never sees your card number or your banking login.
  • When the payment clears, the spot is marked reserved for your dates, the owner is notified with your booking reference, and their contact and access details appear in your account and in your email.
  • Rent for later months is settled directly with the owner on whatever terms the two of you agree. Talli neither collects it nor takes a share of it.
  • The rental agreement itself is between you and the owner. We publish a free generator for one; using it is entirely optional.

§ 6

Cancelling, refunds and withdrawal

Two things apply here. Where they differ, the one better for you is the one that counts.

  • Our rule: a confirmed reservation can be cancelled from your account free of charge within 24 hours of confirmation, and the amount paid comes back in full. A reservation that has not been paid can be cancelled at any time and costs nothing.
  • Your statutory right: as a consumer buying at a distance you have 14 days to withdraw from Talli’s booking service, under the Consumer Rights Act of 30 May 2014. By paying you ask us to begin that service immediately — holding the spot and notifying the owner — and once it has been fully performed the right to withdraw from it is spent. If it is only part-performed, you owe only the part performed.
  • To cancel outside the 24-hour window, or to withdraw, write to hello@tallipark.com and say which booking. No particular form of words is required, and you do not have to give a reason.

§ 7

Once the spot is handed over

From the moment the rental itself starts, it is between you and the owner under whatever you agreed. Ending it, extending it, arguing about the state of the space or recovering a deposit are all matters for the two of you and, if it comes to it, for the courts.

Talli does not hold that money and cannot return it. What we can do is give either side the record of what was booked, and we will, on request from either of you.

§ 8

Listing a space

Anybody entitled to rent out a parking space or garage in Warsaw can publish it here, at no charge. Publishing it means accepting these:

  • The space exists, you may rent it out, and what you write about it — address, price, availability, photographs — is true.
  • Photographs are yours, or you have permission to use them. Publishing them gives Talli a non-exclusive, royalty-free licence to display and resize them on the site, in search results and in alert emails, for as long as the listing is published.
  • No phone number, email address or link in the title or description. The phone field exists for that, and releasing it only to signed-in accounts is what protects it from bulk collection.
  • Keep it current. Take the listing down when the space is gone — one click from your account, and you can restore it later if it frees up again.
  • Answer booking enquiries. Taking somebody’s payment and then ignoring them is the one thing that will get a listing removed and an account closed.

§ 9

When we take something down

We can remove a listing that breaks the rules above, that our checks flag as not being a parking space at all, or that we have been told is unlawful.

Removal is reversible and nothing is destroyed: a listing taken down in error can be restored with its history intact. Where we remove something you published, we tell you, and you can reply to hello@tallipark.com and have it looked at again by a person.

§ 10

Reviews and messages

  • Review a spot only if you have actually used it. One review per person per spot.
  • Nothing unlawful, threatening or discriminatory, and nobody’s personal data. No advertising.
  • Messages exist so a renter and an owner can arrange one specific spot. They are not a marketing channel, and sending unsolicited offers through them will close the account.
  • What you write stays yours. Publishing it here gives us the right to display it on the site. We can remove content that breaks these rules, and we tell you when we do.

§ 11

What you may not do with the site

  • Collect listings, contact details or user data in bulk by automated means. The limit on revealing phone numbers exists for exactly this reason, and working around it is a breach of these terms in itself.
  • Use somebody else’s account, or open one in somebody else’s name.
  • Interfere with how the site runs, probe it for weaknesses without telling us, or reach for data that is not yours.
  • Copy the site’s content, structure or database wholesale. Individual listings link back to their source, and following that link is what the link is for.
  • Use Talli for anything unlawful, or to arrange something the owner of a space has not agreed to.

§ 12

Listings we did not write

Indexed listings are somebody else’s content. We host and display it rather than author it, in the sense the Digital Services Act uses, and we do not check that an indexed price is current, that the space is still free, or that whoever published it may rent it out. Judge them the way you would judge the site they came from — and the link back is there so you can.

If a listing is unlawful, infringes your rights, or is yours and you want it gone, send the link and what is wrong with it to hello@tallipark.com. We act on notices promptly, tell you what we decided and why, and tell whoever published it if we take it down, so that they can respond.

§ 13

The site itself

We work to keep Talli running and accurate. We do not promise that it always will be: listings go stale, sources change shape without warning, and the price in an indexed advertisement is whatever that advertisement says it is.

The live free-space counts come from the City of Warsaw’s open data and are exactly as accurate as that feed is. Treat them as an indication of how a car park is filling up, never as a guarantee that a space is waiting for you.

We can change or withdraw features. Where a change would affect a booking you have already paid for, we contact you rather than letting you discover it.

§ 14

Responsibility

We are responsible for the service we actually provide: taking your payment correctly, holding the spot, passing your details to the owner, and handling your data the way the privacy policy says. Where we get that wrong we put it right or refund it.

We are not responsible for the condition, availability, legality or safety of any parking space, for what an owner or a renter does or fails to do, or for a rental agreement you sign. Those obligations belong to the person on the other side of it.

Nothing here limits liability for death or personal injury caused by our negligence, for deliberate harm, or for anything else Polish law does not permit to be limited. If you are a consumer, your statutory rights come first and this whole section is read subject to them.

§ 15

Complaints

Write to hello@tallipark.com with what happened, when, and what you want done about it. Include the booking reference if there is one.

We reply within 14 days. If we have not replied within 14 days, the complaint is treated as accepted.

If our answer does not satisfy you, there are out-of-court routes and using them is voluntary for both sides: the municipal or district consumer ombudsman, the regional Trade Inspectorate, and the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

§ 16

Changes to these terms

We can change these terms — for a new feature, a fee, or a change in the law. Account holders get at least 14 days’ notice by email before a change takes effect, and the date at the top always tells you which version you are reading.

If you do not accept a change, close your account before it takes effect. A reservation already confirmed stays on the terms it was made under.

§ 17

Law and disputes

Polish law governs these terms and the contract between you and Talli.

If you are a consumer you can bring a claim in the courts of the country you live in, and that country’s mandatory consumer rules continue to protect you. If you are not a consumer, the courts having jurisdiction over Warsaw have exclusive jurisdiction.
